Trust or Will?
One of our clients asked us during their signing appointment:
"Why is there a Will in my packet if I am already signing a Trust?"
And on top of that
"What's the difference between a Trust and a Will anyway?"
Our trust packet includes a pour-over Will that gifts your assets to your Trust. The difference between the Will and the Trust is that the Trust specifically assigns your large assets and personal property into your trust name, making for a seamless transfer to your beneficiaries at your death. When the will is involved, probate may still be necessary in order to transfer anything leftover to your heirs.
It is always best to transfer assets into your Trust while you are alive and well to ensure the quickest and smoothest distribution to your beneficiaries after your death.
